According to the law, the applicant (i.e. the plaintiff) shall submit evidence to prove whether or not the invention patent of the patent at issue should be invalidated for violating paragraphs 1 and 4 of Article 22 of the same act. Where there is insufficient evidence to prove if patent at issue has violated the said provisions, the application for patent invalidation should be overruled.
