[Success Case]
Case No. 2009 Xing-Zhuan-Su-Zi 69, Intellectual Property Court
[Decision Digest]
The interpretation of claims aims to explore the objective significance of claims at the time of filing. In the presumption of patent validity, when there are different interpretations of claims, an interpretation that does not include a prior art and invalidate the patent should be selected to presume the patent is valid. In the doctrine of claim differentiation, each claim is relatively independent and has different scope, and one claim shall not be interpreted as another claim to turn both claims equivalent to each other.
